Battle Over Illinois Gun Laws Headed to the Supreme Court

While the appeal process is pending, the United States Supreme Court received and docketed an emergency motion seeking an injunction against the enforcement of Illinois’ “assault weapons” ban.

The case is City of Naperville, Illinois, v. National Association for Gun Rights. Law Weapons, Inc., d/b/a Law Weapons and Supply, Robert C. Bevis, and the National Association for Gun Rights are among the plaintiffs.

The plaintiffs are requesting an injunction to prevent the implementation of the Protect Illinois Communities Act until the United States Court of Appeals for the Seventh Circuit holds an en banc hearing.

In response to the emergency application, the Office of the Clerk of Court at the Supreme Court stated that Justice Amy Coney Barrett had mandated a briefing.

The state prohibits the sale of AR/AK-style rifles, but owners are still permitted to keep their weapons as long as they register them on a state database. This law is known as the Protect Illinois Communities Act. Residents of Illinois have until January 1, 2024, to register the more than 160 guns that are prohibited in the database.
